Duplicate discussions via API queries

I seem to be getting some discussions reported by the Tender API as both "new" and "open" at the same time. According to the definitions on https://help.tenderapp.com/kb/api/discussions, this shouldn't be possible, as "new" and "open" should be mutually exclusive.

As a simple example, these two queries on our help.neurosky.com domain return the same discussion result
queues/40071/discussions/new
queues/40071/discussions/open

(Many other queries on many of our other queues also return discussions duplicated in both "new" and "open". This was just the simplest example.)

Is this a bug in Tender, or am I misunderstanding the definition of "new" and "open", that they're not actually mutually exclusive?

    Hey Kelvin,

    The API docs were wrong, I corrected them. "New" is a subset of "open": its all the open discussions that have not received any reply yet.
