As the topic says, our customers (two of them so far) have
complained that they are getting "spam" from tender each time a new
ticket is added to the support system. This is really odd, and we
cant figure it out.
Should regular users be able to subscribe to categories? Maybe
thats whats happened... not sure though.

Make sure your users have their email preferences set to only
notify them of discussions they are part of in their profile

Are they seeing this? We added this so people know why they're
getting email. The only way they can start getting notified is by
visiting that page.
